PLEASE READ THESE TERMS OF SERVICE (“Terms”) CAREFULLY BEFORE USING METASOLVES.COM (THE “SITE”). BY ACCESSING OR USING ANY PART OF THE SITE, YOU (“USER,” “YOU,” OR “YOUR”) AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SITE.

1. Agreement to Terms

Your access to and use of the Site constitutes your acceptance of these Terms and any additional terms and policies referenced herein (collectively, the “Agreement”). MetaSolves may revise the Terms at any time by updating this page; continued use after changes become effective means you accept the revised Terms.

2. Intellectual Property Rights

All content on the Site—including, without limitation, text, graphics, logos, button icons, images, audio clips, software code, and the compilation thereof—is owned or licensed by MetaSolves and protected by South African and international copyright, trademark, and other intellectual-property laws. Except for the limited license granted below, no portion of the Site may be used, reproduced, duplicated, copied, sold, resold, or otherwise exploited without MetaSolves’ prior written consent.

Limited License: MetaSolves grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Site for informational purposes and to request consultations, subject to these Terms.

3. User Representations

By using the Site, you represent and warrant that:

  1. You are at least 18 years old or the legal age of majority in your jurisdiction.
  2. You have the legal capacity to agree to these Terms.
  3. You will not access the Site through automated or non-human means (e.g., bots, scripts) except as expressly permitted.
  4. Your use of the Site will not violate any applicable law or regulation.

4. Prohibited Activities

You agree not to:

  • Engage in any data mining, scraping, or harvesting of content.
  • Attempt to bypass, circumvent, or interfere with any security features of the Site.
  • Upload or transmit viruses, worms, or other malicious code.
  • Use the Site to send unsolicited advertising or spam.
  • Reverse engineer, decompile, or disassemble any portion of the Site.
  • Impersonate any person or entity, or misrepresent your affiliation with MetaSolves.
  • Use the Site in any manner that could damage, disable, overburden, or impair its functionality.

5. Submissions

Any information, feedback, or materials you submit via the Site’s contact or consultation forms (“Submissions”) become the property of MetaSolves for the sole purpose of evaluating, responding to, and improving MetaSolves’ services and communications. You grant MetaSolves a worldwide, royalty-free, perpetual license to use, reproduce, and adapt such Submissions for business-communication purposes. MetaSolves will treat personal data contained in Submissions in accordance with its Privacy Policy.

6. Site Management

MetaSolves reserves the right, but is not obligated, to:

  1. Monitor the Site for violations of these Terms;
  2. Take appropriate legal action against anyone who, in MetaSolves’ sole discretion, violates the law or these Terms;
  3. Restrict or disable access to any or all of the Site without notice or liability;
  4. Otherwise manage the Site to protect its rights and property and to facilitate its proper functioning.

7. Term and Termination

These Terms remain in full force and effect while you use the Site. MetaSolves may terminate or suspend your access to the Site at any time, without notice, for any reason—including breach of these Terms. Upon termination, all rights granted to you herein will immediately cease, and you must destroy any downloaded or printed materials from the Site.

8. Modifications and Interruptions

MetaSolves reserves the right to modify, suspend, or discontinue all or part of the Site at any time without notice. The Site may be unavailable periodically for maintenance or other reasons. MetaSolves is not liable for any loss, damage, or inconvenience caused by your inability to access or use the Site during downtime.

9. Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction of the courts located in Cape Town, South Africa, for any dispute arising out of or relating to the Site or these Terms.

10. Disclaimer

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. METASOLVES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE SITE’S OPERATION OR CONTENT, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. METASOLVES DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, METASOLVES, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. METASOLVES’ TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED SOUTH AFRICAN RAND (ZAR 100).

12. Indemnification

You agree to indemnify, defend, and hold harmless MetaSolves and its affiliates, directors, officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your breach of these Terms; or (c) your violation of any applicable law or the rights of a third party.
